These terms are intended for business relationships with commercial customers in food wholesale. They apply only if validly incorporated into the relevant contract. Individually agreed terms take precedence. Publication on this website does not replace an agreement with the customer.

To be confirmed before use: whether supplies are exclusively to businesses. Consumer transactions require a separate review and, if necessary, a separate version.

2. Range and product information

The website presents our wholesale range and the MAKSUTOSKI brand. Presentations are for information and are not binding contractual offers. Availability, pack sizes, quantities and specific product characteristics are agreed for each order. Illustrations may differ from the packaging actually delivered.

Ingredients, allergens, storage conditions and labelling are governed by the information for the item actually ordered. Our team can help with product selection.

3. Enquiries and contract formation

Order enquiries may be made by telephone, email or an agreed communication channel. The customer states products, quantities, business and contact details, and delivery address. We clarify availability and further details personally.

A contract is formed by mutual agreement on the essential order details. An enquiry through the website alone does not constitute an order. Agreements on items, quantities, prices and delivery should be documented for traceability.

4. Prices and payment

The prices agreed for each order apply. VAT, transport and other agreed additional costs are stated in the offer or order agreement. Payment method and due date follow the express agreement.

This version sets no standard payment terms, discounts, minimum order values or extra fees. Statutory rules apply unless otherwise specifically agreed.

5. Delivery and acceptance of goods

Place, scope and date of delivery are agreed for each order. European deliveries are individually agreed subject to transport options. The customer supplies correct delivery details and suitable conditions for receiving the goods.

Deviations or delays are discussed with the customer. Transport costs, partial deliveries and special delivery conditions require agreement. Transfer of risk follows the agreement and applicable law.

6. Storage and food products

After acceptance, the storage conditions stated on the goods, especially temperatures and cold chains, must be observed. The customer must respect best-before or use-by dates and relevant storage, processing and sale requirements.

Visible transport damage or discrepancies should be recorded upon receipt and reported promptly to our team. Statutory inspection and notification duties in business transactions remain unaffected.

7. Changes, complaints and returns

Changes or cancellations are agreed individually. Voluntary returns of non-defective goods require a separate agreement; for food, condition, storage and product safety must be considered in particular.

For complaints, provide order or invoice details, the item, quantity and, where available, batch and photos. These notes do not restrict statutory warranty rights or other claims.

8. Warranty and liability

Applicable statutory provisions govern warranty and liability. This version contains no blanket exclusions of liability or reductions of statutory warranty periods.

9. Data protection

Information on personal data processing is available in our Privacy policy.

10. Applicable law and disputes

Without a separate valid agreement, applicable law and jurisdiction follow statutory provisions. This version sets no exclusive jurisdiction or blanket exclusion of the UN Convention on Contracts for the International Sale of Goods for cross-border deliveries.
